Removal Van Lambeth Service Terms and Conditions
These Terms and Conditions govern the provision of removal and related services by Removal Van Lambeth to customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any booking.
Definitions
In these Terms and Conditions, the following expressions have the following meanings:
Customer means the individual, business, or organisation that requests and purchases services from Removal Van Lambeth.
Services means any removal, man and van, loading, unloading, packing, transportation, or related services provided by Removal Van Lambeth.
Vehicle means any van or vehicle used by Removal Van Lambeth in the performance of the Services.
Agreement means the contract between Removal Van Lambeth and the Customer incorporating these Terms and Conditions and any written quotation or booking confirmation.
Scope of Services
Removal Van Lambeth provides removal and man and van services, including but not limited to domestic and commercial moves, furniture transportation, and related handling services within Lambeth and surrounding areas, as well as to and from other locations in the United Kingdom as agreed at the time of booking.
The exact scope of the Services, including locations, dates, times, and any additional tasks such as packing or furniture assembly, will be set out in the booking confirmation or quotation provided to the Customer.
Booking Process
All bookings for Services must be made directly with Removal Van Lambeth through our designated booking process. The Customer will be required to provide accurate details including collection and delivery addresses, dates and times, access information, the approximate volume or list of items, and any special requirements.
Removal Van Lambeth will provide a quotation or estimate based on the information supplied. Quotations are usually given as either a fixed price or an hourly rate, which will be specified in the booking confirmation. Any quotation is subject to change if the information provided by the Customer is inaccurate or incomplete, or if the scope of work changes.
A booking is only confirmed when Removal Van Lambeth has issued a booking confirmation and, where required, the Customer has paid any applicable deposit. Removal Van Lambeth reserves the right to refuse any booking at its discretion.
The Customer is responsible for checking that all details in the quotation and booking confirmation are correct. Any errors must be reported to Removal Van Lambeth as soon as possible and, in any event, before the Services are due to commence.
Customer Responsibilities
The Customer must ensure that:
All goods to be moved are properly packed, secured, and prepared for transport unless packing services have been specifically booked.
All items are ready to be moved at the agreed time and that sufficient access is available at both the collection and delivery addresses.
Parking arrangements are in place and any required permits are obtained where necessary. Any parking fines or penalties arising from inadequate arrangements or restrictions will be the responsibility of the Customer.
Any fragile, valuable, or special items are clearly identified and notified to Removal Van Lambeth in advance.
All items to be removed are legal to transport and comply with applicable safety and waste regulations.
Access and Parking
The Customer must provide accurate information regarding access to the properties involved, including stairs, lifts, narrow doorways, restricted vehicle access, or parking limitations.
If the Vehicle cannot be parked within a reasonable distance of the property due to access or parking issues, additional time and charges may apply. Where parking restrictions exist, the Customer must arrange suitable permits in advance or pay any additional costs incurred as a result of such restrictions.
Removal Van Lambeth will use reasonable care when moving items through tight spaces. However, where access is particularly restricted, the Customer accepts that some items may not be moveable without risk of damage to the item or the property. In such circumstances, Removal Van Lambeth may decline to move specific items or proceed only with the Customer’s express acceptance of the associated risks.
Payments and Charges
Charges for the Services will be specified in the quotation or booking confirmation and may be calculated on a fixed price or hourly basis. Any additional charges will be communicated to the Customer where reasonably possible.
Unless otherwise stated in writing, payment terms are as follows:
Deposits may be required to secure a booking. The deposit amount and due date will be stated in the booking confirmation.
For hourly rate bookings, the chargeable time begins when the Vehicle and crew arrive at the agreed collection address and ends when unloading at the final destination is completed.
For fixed price bookings, the price is based on the agreed scope of work. Changes to the scope, including additional items, extra stops, or delays outside the control of Removal Van Lambeth, may result in extra charges.
Unless a different arrangement is agreed in writing, the balance of payment is due on completion of the Services. Removal Van Lambeth reserves the right to withhold unloading or delivery of goods until payment is received in full.
If payment is not made in accordance with these terms, Removal Van Lambeth may charge interest on overdue sums and may retain goods under a lien until full payment is received, subject to applicable law.
Cancellations and Amendments
If the Customer wishes to cancel or amend a booking, the Customer must notify Removal Van Lambeth at the earliest opportunity.
Cancellation terms are as follows, unless a different policy is specified in the booking confirmation:
Cancellations received more than 7 days before the scheduled service date may be made without a cancellation fee. Any deposit paid may be refundable or transferable at the discretion of Removal Van Lambeth.
Cancellations received within 7 days but more than 48 hours before the service date may incur a cancellation fee up to a specified percentage of the quoted price, to cover allocated time and resources.
Cancellations received less than 48 hours before the service date or failure to be available at the agreed time may be charged up to the full quoted price.
Where the Customer requests a change of date, time, or scope of work, Removal Van Lambeth will use reasonable efforts to accommodate the request, subject to availability. However, changes may result in revised pricing and terms, and are not guaranteed.
Removal Van Lambeth reserves the right to cancel or postpone a booking due to circumstances beyond its reasonable control, such as severe weather, road closures, accidents, illness, or Vehicle breakdown. In such cases, Removal Van Lambeth will endeavour to rearrange the Services as soon as reasonably possible. Liability for such cancellations will be limited to the return of any deposit or prepayment for Services not performed.
Excluded and Restricted Items
Removal Van Lambeth will not knowingly transport the following items:
Hazardous materials, including but not limited to flammable, explosive, corrosive, or toxic substances.
Illegal goods or items obtained unlawfully.
Perishable goods that may spoil or attract pests.
Cash, jewellery, watches, precious metals, or other high-value items unless expressly agreed in writing.
Animals, plants, or live organisms.
The Customer is responsible for ensuring that none of the above items are included in the consignment without prior written agreement. Removal Van Lambeth accepts no liability for loss, damage, or consequences arising from the transport of prohibited items that were not disclosed.
Liability and Insurance
Removal Van Lambeth will exercise reasonable care and skill in providing the Services. However, the Customer acknowledges that minor scratches, scuffs, or wear may occur during normal moving activities.
Removal Van Lambeth’s liability for loss of or damage to goods is limited to a reasonable amount per item or per job, as may be specified in a quotation or policy communicated to the Customer. The Customer is advised to obtain appropriate insurance cover for high-value or fragile items and to disclose any particularly valuable items in advance.
Removal Van Lambeth will not be liable for:
Damage arising from the Customer’s failure to adequately pack, protect, or label goods.
Damage to the interior or exterior of a property where such damage arises from moving items through tight or restricted access and the risk was explained or was obvious.
Loss or damage caused by wear and tear, inherent defects, pre-existing damage, or the nature of the goods.
Indirect, consequential, or economic losses, including loss of profits, loss of use, or loss of opportunity.
Any loss or damage arising from delays caused by circumstances outside the reasonable control of Removal Van Lambeth, such as traffic conditions, weather, road closures, or acts of third parties.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited.
Claims and Complaints
If the Customer believes that any goods have been lost or damaged, or that the Services have not been carried out with reasonable care and skill, the Customer must notify Removal Van Lambeth as soon as reasonably practicable and provide details of the issue.
Any apparent damage should be reported at the time of service completion where possible, and in any event within a reasonable period afterwards. The Customer should retain any damaged items and provide evidence, including photographs, to support the claim.
Removal Van Lambeth will review any complaint or claim in good faith and may request additional information. Where appropriate, Removal Van Lambeth may offer repair, replacement, or compensation within the limits of its liability.
Waste and Disposal Regulations
Removal Van Lambeth operates in compliance with applicable waste and environmental regulations. We are not a general waste disposal service and cannot remove or dispose of certain categories of waste, including hazardous or prohibited materials.
Where the Customer requests disposal of unwanted items, this must be agreed in advance. Charges for disposal will depend on the nature and quantity of the items. The Customer is responsible for accurately describing items for disposal so that any necessary arrangements and charges can be determined.
Items accepted for disposal will be handled in accordance with relevant waste regulations. Removal Van Lambeth may refuse to remove or dispose of items if they are not as described, appear hazardous, or are otherwise unsuitable for removal in accordance with legal or environmental requirements.
Delays and Force Majeure
Removal Van Lambeth will use reasonable efforts to adhere to agreed dates and times, but the Customer acknowledges that delays can occur due to traffic, weather, road incidents, or other circumstances beyond reasonable control.
In the event of a delay, Removal Van Lambeth will inform the Customer where reasonably possible and will complete the Services as soon as practicable. Time is not of the essence unless expressly agreed in writing.
Removal Van Lambeth will not be liable for failure or delay in performing its obligations where such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, severe weather, accidents, public transport or road network disruptions, strikes, or other industrial disputes.
Customer Conduct and Safety
The Customer must ensure a safe working environment for the crew at all times. This includes keeping pathways clear, supervising children and pets, and not asking the crew to undertake tasks that may be unsafe or outside the agreed scope of work.
Removal Van Lambeth reserves the right to suspend or terminate the Services immediately if the crew are subjected to abusive, threatening, or unsafe behaviour, or if conditions at the property present unacceptable risks. In such circumstances, charges may still apply for the time and resources allocated.
Data Protection and Privacy
Removal Van Lambeth will collect and use personal data of the Customer only as necessary for the performance of the Services, for administration, and to comply with legal obligations. Personal data will be handled in accordance with applicable data protection laws.
By making a booking, the Customer consents to the use of their personal data for the purposes of managing the booking, providing the Services, processing payments, and, where permitted, for relevant service communications.
Variation of Terms
Removal Van Lambeth may update or amend these Terms and Conditions from time to time. The version in force at the time of the booking will apply to the Agreement for that specific service, unless otherwise agreed in writing.
Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, the remaining provisions shall continue to be valid and enforceable.
Governing Law and Jurisdiction
These Terms and Conditions and any Agreement between Removal Van Lambeth and the Customer shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes arising out of or in connection with these Terms and Conditions or the Services provided shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Entire Agreement
These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between Removal Van Lambeth and the Customer in relation to the Services. No other terms, conditions, or representations, whether oral or written, shall form part of this Agreement unless expressly agreed in writing.
